Please read these Terms of Service ("Terms") carefully before using the Bid-Concierge website or services. By accessing or using our Site, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. About Our Services

Bid-Concierge provides a paid concierge service that connects homeowners with local contractors across Greater Houston and surrounding counties. Our services include:

• Bid Collection ($24.99): We contact 3–5 vetted contractors on your behalf, request estimated price ranges for your described project, compile the responses, and deliver a summary report to you within 48–72 business hours.
• Bid + Negotiate ($99): In addition to estimate collection, we engage with your preferred contractor to negotiate pricing and scope on your behalf using our industry knowledge.
• Contractor Preferred Network (Free to join, 5% referral fee on closed jobs): Licensed contractors may apply to join our network and receive qualified project leads.

Important Note on Estimates: Phase 1 estimates compiled by Bid-Concierge are based on project descriptions provided by homeowners and represent good-faith price ranges only. Final contract pricing is determined after an on-site evaluation by your selected contractor. Bid-Concierge does not guarantee that final contract prices will match Phase 1 estimate ranges.

2. Two-Phase Project Process

Bid-Concierge operates on a structured two-phase process to protect homeowners and ensure transparent, accurate pricing.

• Phase 1 — Bid Collection: After you submit your project request and payment, we contact vetted contractors in your service area and collect estimated price ranges. These are compiled into a Bid Summary Report and delivered to you within 48–72 business hours. You review the estimates and select your preferred contractor for a site visit.
• Phase 2 — Site Visit & Formal Estimate: Your selected contractor schedules an on-site evaluation and submits a formal written estimate through Bid-Concierge. You will receive the formal estimate and may accept or decline it through Bid-Concierge. If you accept, your submission fee is credited toward your deposit and the project proceeds. If you decline, you may select another contractor from your original bid summary for a site visit.

3. Submission Fee & Credit

Payment for Bid Collection ($24.99) or Bid + Negotiate ($99) is due at the time of project submission via Stripe. Your submission fee is handled as follows:

• Credited: If you accept a formal estimate and proceed with a contractor, your submission fee is credited toward your deposit payment. You will pay the deposit amount less your submission fee.
• Refunded: If you decline all formal estimates before any site visit has occurred, your submission fee is fully refunded within 5–7 business days.
• Non-refundable: Once a site visit has been completed by any contractor, the submission fee is non-refundable regardless of whether you proceed with a project.

If Bid-Concierge is unable to obtain any contractor responses within 5 business days of your submission, a full refund will be issued regardless of the above conditions.

4. Deposit Payment Through Bid-Concierge

To protect both homeowners and contractors, all project deposits are collected and disbursed through Bid-Concierge. Upon acceptance of a formal contractor estimate, the following applies:

• You will be invoiced for the deposit amount specified in the contractor's formal estimate, less your submission fee credit, via secure Stripe payment
• Your deposit payment is held by Bid-Concierge and disbursed to your selected contractor within 5 business days after receipt
• Bid-Concierge deducts its referral fee from your deposit before disbursing the remainder to the contractor — this does not increase your deposit amount
• All remaining project payments after the deposit are made directly between you and your contractor

Note: The deposit amount is set by your contractor as part of their formal estimate. Bid-Concierge does not determine deposit amounts.

5. Refund Policy

The following refund policy applies to your Bid-Concierge submission fee:

• Full refund: No contractor responses received within 5 business days of submission
• Full refund: You decline all formal estimates before any site visit has occurred
• Non-refundable: A site visit has been completed by any contractor, regardless of whether you proceed
• Credited toward deposit: You accept a formal estimate and proceed with a contractor

Refunds are processed within 5–7 business days and returned to your original payment method. Deposits paid directly to Bid-Concierge are governed by the refund terms set forth in your contractor's formal estimate and are not refunded by Bid-Concierge once disbursed to the contractor.

6. Payment Terms & Processing Fees

All homeowner payments are processed through Stripe. Processing fees are passed through at cost with no markup by Bid-Concierge.

• Bid Collection: $24.99 + applicable Stripe processing fee
• Bid + Negotiate: $99.00 + applicable Stripe processing fee
• Project Deposit: Contractor-defined amount, less submission fee credit, + applicable Stripe processing fee

7. Contractor Referral Fee Disclosure

Bid-Concierge charges contractors a referral fee on projects that proceed through our platform. This fee is paid by the contractor, not the homeowner, and does not increase the price you pay for your project. The referral fee is deducted from the contractor's deposit disbursement before it is sent to them. The fee structure is:

• Projects $0 – $10,000: 5% of total contract value, deducted from deposit disbursement
• Projects over $10,000: 2.5% deducted from deposit disbursement + 2.5% invoiced to contractor at project completion
• Change orders: 5% of change order value, invoiced to contractor

8. No Contractor Relationship

Bid-Concierge is strictly a referral and facilitation service. We are not a contractor, subcontractor, construction manager, or agent of any contractor. We do not supervise, manage, or guarantee the work performed by any contractor. All contracts for construction work are entered into solely between you and the contractor of your choice.

We make no warranties or representations about the quality, timeliness, legality, or fitness of any contractor's work, estimates, or bids.

9. Contractor Vetting Disclaimer

While we make reasonable efforts to include contractors who are licensed, insured, and in good standing in Texas, we do not guarantee, warrant, or independently verify the credentials, license status, insurance coverage, or quality of work of any contractor in our network. It is your responsibility to independently verify a contractor's credentials before entering into any agreement with them.

You can verify contractor licensing in Texas at the Texas Department of Licensing and Regulation (TDLR) at tdlr.texas.gov.

10. Accuracy of Information

You agree to provide accurate, complete, and truthful information when submitting a project request. Inaccurate project descriptions may result in bids that do not reflect actual project costs. Bid-Concierge is not responsible for bid inaccuracies caused by incomplete or incorrect information provided by you.

11. No Guarantee of Savings or Results

Bid-Concierge does not guarantee that you will receive lower prices, save money, or obtain a contractor as a result of using our services. Bid outcomes depend on market conditions, contractor availability, and project scope. Our negotiation service represents our best efforts but does not guarantee a specific outcome.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Bid-Concierge, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to:

• Disputes between you and any contractor
• Construction defects, delays, or cost overruns
• Contractor non-performance or breach of contract
• Inaccurate bids or estimates provided by contractors
• Loss of deposit funds due to contractor non-performance after disbursement

Our total liability to you for any claim arising from our services shall not exceed the amount you paid to Bid-Concierge for the specific service giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Bid-Concierge and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of our services, your violation of these Terms, or any dispute between you and a contractor.

14. Intellectual Property

All content on the Bid-Concierge website, including text, graphics, logos, and design, is the property of Bid-Concierge and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Fort Bend County, Texas, and you consent to the personal jurisdiction of such courts.

16. Changes to Terms

We reserve the right to update these Terms at any time. We will post the revised Terms with an updated effective date. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
